Abstract

In relation to rapid age advance and thinking development on people, it need a tool that support the law in gathering and facilitating the legal development. One of support in advanced technology that has capable to be used as a tool that can meet legal need if the law develops following age advance. That is the technology of teleconference, where teleconference is a medium that facilitates law in giving information for the witness in court when it run. Through this medium, the witness states the evidence though they do not need present directly in court. Teleconference get much challenges from legal expert, where according to them, witness should inform the evidence directly (present in court), and according to the other, statement of the witness in giving the evidence via teleconference is not legitimate because the evidence is opposite to article 185 KU HAP where it state that "information of the witness as evidence tool is what the he or she said in court." However, in this matter it needs to consider good intention of the witness in giving evidence to present in court, though not directly. Considering location of the witness is far away from the place of court or those that have a sickness then it does not need to present in court. Teleconference is a medium that allows the witness to ease in giving evidence everywhere and anytime. Also, they can give an evidences followed by other comparing medium to prevent deviance in giving information by the witness in court. By this following problem, then researcher was interested to study about this matter and try to find answer of this question.
