Abstract

Problems studied in this researches is what is in each judge decided has been use basic consideration which objective of the rehabilitation punishment to narcotics addict in special region of Yogyakarta. This method of research is a normative legal research, i.e. research which refers to the legal norms contained in laws and regulations, court decisions and practices relating to instruction about the punishment of narcotics addict special region of Yogyakarta. Analysis of the data used is qualitative analysis. Data obtained from this study with data derived from literature on primary legal materials, secondary and tertiary are then analyzed with descriptive qualitative reasoning is to create a description based on the existing quality. The result of the study obtained data are studied and discussed as a comprehensive materials. The result of this study is each the rehabilitation punishment to narcotics addict in special region of Yogyakarta, judge basic consideration has been suitable with regulation which in the letter orbit supreme court and regulation supreme court. Until judge also look at the regulation which in the law and any others facts which revealed at the court like any asesmen and analysis from analysis group as recommendation plan traphy and rehabilitation narcotics addict. Until we can said that each the rehabilitation punishment to narcotics addict in special region if Yogyakarta already suitable with the law and the others support facts .
