Abstract

Applying standard clause on assurance agreement make existence of the principle of freedom of contract as a most important principle in contract law is lack. This research discusses about the implementation of the principle of freedom of contract on assurance agreement to give a justice for endured as a consumer. The method that use on this research is normative juridical method, this approach method uses approach of regulation of law in Indonesia and approach of analysis, the law materials which obtained from document, literature, journal, doctrine, and law principle. The data obtained from resource person and legislation product related Prudential life assurance agreement as an object of research. Materials analysis which compare between the document of Prudential Life Assurance agreement and the regulation of law that related with assurance agreement. The result from this research is assurance agreement especially in Prudential Life Assurance Agreement has been implementation the principle of the freedom of the contract, that give 14 days’ period of time to endured for cancel the agreement. According to this research, on making of standard clause that will be put on assurance agreement must be involving consumer protection institute to extend justice for endured as a consumer.
