Abstract

Cabotage principle which is exclusive right has been applied to protect air space and maritime of a state. This principle also applied to voyage sector which is order only ship uncasing state’s flag that is allowed to sailing on state of flag’s territorial water. Nowadays there are many communities which are established by many countries such as ASEAN. This community was established between few countries in Southeast of Asia region. The aim and purpose of this community is to accelerate economy growth, social progress and cultural development each member country. Then, this community agreed to create economic integration area calling ASEAN Economic Community. It orders all obstacles in trade to be cleared. This article will formulate the existence of cabotage principle whether this principle is one of obstacle or not. The research shows that this principle is still maintained. There is nothing agreement which is forbidden this principle.
