Abstract

Indonesia is still a developing country and needs assistance from the international community, especially the United Nations (UN) through its special agency, UNHCR in dealing with Rohingya refugees. Based on the explanation above, this thesis seeks to find a legal umbrella for UNHCR in carrying out its duties in a transit country. This research is entitled "The Role of the United Nations High Commissioner For Refugees (UNCHR) in Providing Protection to Refugees in Transit Countries Viewed from the 1967 Geneva Convention (Case Study of Rohingya Refugees in Indonesia)". The research question raised in this writing is "How is the role of UNHCR in providing protection to refugees in transit countries viewed from the 1951 Geneva Convention and the Additional Protocol to the 1967 Geneva Convention in the case study of Rohingya refugees in Indonesia?". This thesis uses a normative approach which uses primary, secondary and tertiary legal materials. The data will be analyzed by descriptive analysis method with the deductive thinking process. This research concludes that the role of UNHCR in Indonesia starts from the determination of refugee status which is then followed by placement in third countries, repatriation and finding long-term solutions for refugees. Regarding the obstacles faced, UNHCR provides some Income Generating Activities program that will provide income which is very beneficial for refugees in Indonesia.
