Abstract

Refugees in Indonesia who are waiting for resettlement did a demonstration and settled in front of the UNHCR office on Kebon Sirih street. The refugee activities disturbed the public order in the surrounding areas of UNHCR. To maintain public order and based on humanity, the Provincial Government of DKI Jakarta moved refugees to Kalideres. Legal Issues in this research are to examine how the role of UNHCR in fulfilling refugee rights and what is hampering the fulfillment of refugee rights in Kalideres. The legal research method used is normative legal research. Normative legal research is a search for international provisions like The Geneva Convention in 1951, The Protocol of New York 1967, The Statute of UNHCR and The Universal Declaration of Human Rights. All of that provisions are presented descriptively by providing interpretations and descriptions following the problems that the author search for. This research concludes that UNHCR has ensured that refugees avoid refoulement and UNHCR has conducted Refugees status determination to assess the validity of protection requests submitted by refugees. In the case of refugee Kalideres, UNHCR has conducted a Bourne Ability Assessment tool aimed at finding refugees who most need help. UNHCR also fulfills the basic needs of refugees such as food, drinks, shelter, health services and fulfillment of education rights. However, UNHCR experiencedseveral obstacles including limited funding owned by UNHCR Indonesia and the Provincial Government of DKI Jakarta. Another obstacle comes from refugees who do not want to get a formal education in the schools that have been provided and many refugees refuse to work independently. The limited number of resettlement countries is only 20 countries and the reduced quota for refugees is another obstacle for UNHCR.
