Abstract

The humanitarian conflict and the rise of the Taliban regime in Afghanistan have forced some 2.6 million Afghan nationals to leave the country to seek asylum to other countries, including Indonesia. One of the areas in Indonesia that is the destination of asylum seekers is Batam City, Riau Islands Province. There are about 345 asylum seekers from Afghanistan who are currently living in immigration detention centers. The problem is that until now the rights of these asylum seekers have not been properly fulfilled, including uncertainty regarding the third country that is the recipient of the asylum seeker. The problem of this study is about what the United Nations High Commissioner for Refugees (UNHCR) faced so that it cannot immediately determine refugee status for asylum seekers of Afghan origin in Batam City and cannot immediately relocate asylum seekers from Afghanistan in Batam City to a third country and how efforts should be made by the United Nations High Commissioner for Refugees (UNHCR) in fulfilling the rights of Afghan refugees in Batam City Province Riau Islands. The research method used in this study is a normative legal research method, which is based on primary legal materials in the form of the 1951 Geneva Conventions, the 1967 New York Protocol and other international agreements related to human rights. The results of this research are that the fulfillment of the rights of asylum seekers from Afghanistan in Batam City has not gone well because there are policies from the Indonesian Government that hinder this, for example the prohibition of work for asylum seekers and the lack of state parties to the 1951 Geneva Convention and the 1967 New York Protocol that are willing to accept refugees relocation.
