Abstract
Despite legal provisions protecting trademark owners through Act No. 20 of 2016 on Trademarks and Geographical Indications, unauthorized use of well-known trademark continues to occur especially for products labeled as KW (imitation) goods. In particular, Lab Art Aromatique sells products under the "Character Parfum" label, closely resembling established well-known marks like "CHANCE CHANEL EAU VIVE" and "Dolce & Gabbana Light Blue." In the usage and registration of trademarks, it is prohibited to be substantially similar to other trademarks in order to protect the rights of trademark owner. Although statutory provisons prohibit trademarks from being substantially similar to other marks, the law does not provide a precise definition of this concept, leading to ambiguity in determining whether actions such as those of Lab Art Aromatique constitute trademark infringement. To address this issue, this research aims to define similarity in essence to other trademarks. By using a normative-legal research methodology and analyzing primary and secondary legal sources, this study seeks to clarify the interpretation and application of trademark regulations, particularly in assessing infringement based on similarity in essence to established well-known marks. The research concludes that under Indonesian law, no distinction exists in assessing similarities between registered and well-known trademarks. Well-known trademark owners possess legal protection rights, enabling infringement actions despite of its registration status. Secondly, Lab Art Aromatique has committed trademark infringement by utilizing labels that closely resemble well-known trademarks. This violation encompasses visual, phonetic, and associative similarities between Lab Art Aromatique's labels and established brands, demonstrating a clear intention to deceive consumers.
