Abstract

Thesis entitled “the responsibility of the Garuda Indonesia airline to CV. Losari Jaya for compensation for delays in sending tuna cargo.” Cargo delivery is a very important service because Indonesia is an archipelagic country. Cargo delivery is also not free from errors which can cause damage to the cargo. This research was used to find out the responsibility of the Garuda Indonesia airline to CV.Losari Jaya for compensation for delays in sending tuna cargo. The research was conducted with empirical legal research that focuses on social facts. This research data is obtained by interviewing respondents related to waste problems and literature study, through regulations, books, journals, and newspapers. The result of this research is the compensation proposed by CV.Losari Jaya in the amount of Rp. 180,000,000.00 to the Garuda Indonesia airline does not need to be paid in full by Garuda Indonesia, because the law stipulates that if the price of the cargo exceeds the value regulated by law, then a special agreement is needed to regulate the compensation. The suggestions from this research are to increase knowledge of consumer rights and obligations as consumers of cargo delivery services and better understand the special conditions that can be carried out by carriers and consumers in order to avoid losses that can be experienced by both parties.
