Abstract

The United States Diplomatic and Consular Staff in Tehran 1980 case was a case of forced occupation of the United States Embassy Building and hostage-taking of diplomatic officials, consular officers, Embassy staff, and visitors to the Embassy carried out by Iranian militant students. This study focuses on the analysis of the actions of Iranian militant students who occupied and took hostage US diplomatic officials in Tehran based on the 1961 Vienna Convention on Diplomatic Relations. This study uses a normative legal research method based on international conventions and decisions of the International Court of Justice handling this case. Based on the study, it was found that the actions taken by Iranian militant students and the Iranian Government were contrary to the principles of Diplomatic Law in the 1961 Vienna Convention. The advice that can be given based on this case is that the receiving states must uphold and implement the rules in the 1961 Vienna Convention and the principles in Diplomatic and Consular Law, as well as Customary International Law.
