Abstract

The aim of this research is to know and to see deeply, the factors which basicly cause the debating between legislation and Constitution of the Republic of Indonesia Year 1945 based on constitution assembly decision upon the house of representative bill in legislative process towards the decision implication of constitution assembly on legislation trial. Approach of political law is used in this research to form Ius Constituendem as an effort to reduce the increasing amount of requests and Constitution Assembly decision over material law,and to raise the House of Representatiive effort in implementing legislatif power. It is known by this research that in general factors which basicly caused debating between legislation and Constitution of the Republic of Indonesia Year 1945 based on Constitution Court decision upon legislation trial is factors of improfesionality of legislation makers in forming legislation, such as individual impotance or the importance of certain groups, also the lacking of knowledge from the member of parliament about legislation and regulation. Action of buying and selling chapter are very difficult to be proven. Law of House of Representatives responsibility in legislation prosess towards Constitutional Court decision implication upon legislation trial, responsibility can be asked from House of Representative. The responsibility can be asked based on the actions which have been done during the process of forming legislation. The results of research stated that Ius Constituendum House of Representatives law legislation. Responsibility in legislative process upon constitution Court decision implication on law legislation trial is by making revision in law legislation which design the mekanism the member of legislatife candidate, revision in law legislation which becomes the rule of farming law legislation also, It must have The House of Representatives internal of coherent sanction or a politic party.
