Abstract

The title of this thesis is “Discrimination towards Pregnant Students’ Fulfillment of Education Rights”. The objective of this thesis is to know and to study the discrimination towards pregnant students’ fulfillment of education rights. This research is a normative research and it uses the law sociology approach. The sources of the data are taken from secondary data which consists of primary law material and secondary law material. The data collecting methods are by doing a library research and interviews. The primary law material and the secondary law material are analyzed by using law analysis method. The deductive way of thinking process is used to draw the conclusion. The gender theory is used as the analysis tool to study the research finding. The result of this study shows most of the pregnant students do not get their education rights after the pregnancy. The examples of the discriminative actions are they cannot join the national exam, they do not get special treatment, rule out the basic principles of child rights convention. This discrimination appears as people close the cases, there is no regulation that manage pregnant students, society judges that pregnant students are negative and schools are afraid to keep the pregnant students stay in schools and there is agreement between schools and students to obey the regulation.
