Abstract

The title of this legal writing is legal certainty for the landowner in the development and transmigration settlement area in Sorong Regency the Province of West Papua. The research was aimed at identifying, reviewing and analizing whether the landowner in the development and transmigration settlement area in Sorong Regency the Province of West Papua has acquired legal certainty. The method of the research was the empirical legal research and the file obtained was analyzed qualitatively. Based on the analysis, the researcher then drew the conclusion with the inductive method. The result of this legal writing indicated that the transmigrant and population which is not transmigrant in the development and transmigration settlement area has acquired legal certainty in the form of a certificate of land. The researcher suggested the development and transmigration, the land office and the notary in Sorong Regency should coordinate each other so there there would be no transfer of the land as mentioned in article before ten years since the land was registered for the population which is not transmigrant.
