Abstract

The legal writing entitled the Policy of Regional Government of West Borneo in Protecting Local Product towards the Threat of Chinese Products as Impact of Implementation of ASEANChina Free Trade Area (ACFTA). The problem formulation of this legal writing was what policies conducted by Regional Government of West Borneo to protect local products towards the threats of foreigner products especially Chinese product as impact of Implementation of ASEAN-China Free Trade Area (ACFTA). The purpose of research was to know the particular policy conducted by regional Government of West Borneo in coping with the happening of free trade amongs Indonesia and China, which will be implemented to protect the continuity of local products from the treats of Chinese products. This research exposes normative legal research, which focuses on the norms and this research needs secondary data (legal source) as primary source. The source of data in this research were primary legal source, come from relating regulations, secondary data (legal source) as primary source. The source of data in this reseacrh were primary legal source, come from relating regulations used in this research was literary study by finding and analyzing literatures relating to international trade law. In this research, the author also conducted interview with the source person from Office of Trade Committee of West Borneo Province in Pontianak City, Bureau of Economy of Regional Secretary of West Borneo Province, Bureau of Law of Regional Secretary of West Borneo Province. Method of data alaysis was qualitative by using juridical data which is not based on the total of certain quanity. It used deductive reasining method, through deduction process of valid positive legal norm, i.e. regulations ruling on the international trade in particulary on World Trade Organization and regulations relating to the ASEAN-China Free Trade Area (ACFTA). The result of research, approves the province of West Borneo enforces policies to product it’s local product towards the threat of Chinese product by the implementation of ACFTA, i.e. by implementing National Standardization Institution for all of it’s products. To threat the ACFTA 2010, the efforts or policies conducted by the regional government of West Borneo are : 1) increase the export competitiveness by considering direct and indirect factor; 2) conduct research and developement of technology in addition of intensification of technology change and buying technology; and 3) exploits the national and regional superiority by using domestic technology, those are : biodiesel, electricity, turf soil electricity.
