Abstract

This study aims to: first, knowing and evaluating the responsibilities of the government in the fulfillment of children's right to self-identity in the form of a birth certificate, secondly, to know and evaluate what the problem is for the government in an effort to carry out the responsibilities of fulfilling children's right to self-identity in the form of a birth certificate; Third, identify and evaluate the harmonization of the Law No. 23 Year 2006 concerning Population Administration with Law No. 23 Year 2002 on Child Protection, which mandates the government's responsibility in the implementation of service delivery as low birth registration at the village level. Types of research used in this study is a normative legal research. Legal approach used in this study is the approach to the politics of law and sociology of law. Process analysis of legal materials starting from primary legal materials by descriptions of legal materials, systematization of legal materials, legal materials synchronization, interpretation of legal materials and the level of legal theory to evaluate legal materials. Responsibility of the central government in the fulfillment of children's right to self-identity in the form of a birth certificate is the responsibility of the command of the Constitution of the Republic of Indonesia of 1945 that the President passed the Act No. 23 of 2006 concerning Population Administration, issued Government Regulation, and to develop regulations President. President assisted by the minister in charge of government affairs duties related to the conduct of civil registration. Yogyakarta city government has established regulations on the administration of the population of Yogyakarta Regulation No. 7 of 2007 on the Implementation of the Population Administration promulgated on October 24, 2007. Implementation organizing paperwork population in the city of Yogyakarta Yogyakarta Regional Regulation No. 10 Year 2008 on the establishment, composition, and Duty Position Regional Office. Obstacles for the government to carry out the responsibilities of fulfillingchildren's right to self-identity in the form of a birth certificate include the rule of law on the principle of the events, there are still many people who are reluctant or not mensegerakan looking for a birth certificate in the event of a birth, the Head of Department is the only official civil registration, shortage of personnel services officer birth certificate, Every resident subject to administrative sanctions in the form of fines, Yogyakarta Regulation No. 7 of 2007 on the Implementation of Population Administration does not regulate the implementation of minimum service standards issuance of birth certificates, and obligations of the Stipulation by the Court for the people who are late reporting of births more than 1 (one) year caused the population to be increasingly reluctant to take care of a birth certificate. There is disharmony between Law No. 23 of 2002 on Child Protection on the implementation of the birth certificate as low at village level to the Law No. 23 Year 2006 concerning Population Administration at the District level.
