Abstract

The rights of every workers in Indonesia is to get social security as provided by the government as in Article 99 Act of the Republic of Indonesia Number 13 year 2003. One of the Social Security for the workers is held by The Social Security Administrator (BPJS). This research aims to answer the fulfillment of the workers rights to the BPJS Ketenagakerjaan for coffee shop employee in Yogyakarta, Indonesia. The research was conducted under the basis of empirical study as primary data were obtained from the field research while the secondary data were obtained from the library research. All the collected data is analyzed with a qualitative method. As the result showed, the Lagani Coffee & Co. employer have not fulfill the workers rights with the BPJS Ketenagakerjaan. Nevertheless, the employer still providing the employee with the facilities and willing to fulfill the workers rights to the BPJS Ketenagakerjaan as for the employee who independently register themselves. This is according to Article 15 Act of the Republic of Indonesia Number 24 year 2011 jo The constitutional court number 82/PUUX/ 2012 regulated workers are be able to enroll themselves independently.
