Abstract

War was one of the causes of damage to the environment. Therefore international humanitarian law regulates the protection of the environment during war. In practice, these provisions are often violated, so we need special arrangements in the form of enforcement and accountability imposed on the country for violation of this law. This study of environmental liability issues through international humanitarian law and its enforcement examines the normative juridical based on the norms of positive law. The study used the process of data analysis and reasoning methods to draw conclusions on this issue. From the data analysis it can be concluded that it is the responsibility of the state when environmental damage occurs as a result of armed conflicts. The state must make appropriate remedies for violations that occurred, in this case the restoration of the environmental damage. Other forms of liability that the state must take on when violations occur that cause material losses is paying compensation or damages in the form of a sum of money.
