Abstract

ABSTRACT A decent life is the right of citizens. The fulfillment of citizens' rights is determined by the creation of social justice for all citizens. With limited employment and inadequate skills, it was found that people chose to live by wandering and begging. The situation of trash and begging is increasing, the Government of the Special Region of Yogyakarta Number 1 Year 2014 concerning Handling of Homeless and Beggars. The ratification of the regulation actually triggered pros and cons because there was a criminal sanction applied. Therefore it is necessary to raise the issue regarding the Effectiveness of Criminal Sanctions in the Management of Emotions and Emphasis Based on Regional Regulation Number 1 Year 2014 concerning Handling of Homeless and Beggars in the Special Region of Yogyakarta. This study aims to determine whether criminal sanctions in Regional Regulation Number 1 Year 2014 of the Special Region of Yogyakarta are effective for overcoming vagaries and begging. This legal research is empirical legal research. This research was conducted with interviews obtained from speakers and respondents related to homeless and beggars. This study concludes that criminal sanctions have not been effective because of the obstacles in their application. Satpol PP is still having difficulties in determining parties that can be subject to criminal sanctions and proof of the existence of criminal elements in the application of Regional Regulation Number 1 Year 2014 concerning Handling of Homeless and Beggars in the Special Region of Yogyakarta.
