Abstract

This thesis is entitled "Consideration of Judges in deciding Narcotics Criminal Case for Perpetrators experiencing Dual Diagnosis". Availability of narcotics that are very necessary as a drug to improve human health. Therefore, regulations are needed to carry out threats and eradicate hazards and illicit trafficking of narcotics and narcotics. Narcotics effects are like coins that have two different sides, can heal and can also be deadly to the user if not appropriate. Narcotics can cause psychological and physical disorders. One form of psychic effects of narcotics is Dual Diagnosis, Dual Diagnosis or mental disorders and drugs that can cause each of them. People who have been in contact with these drugs and can help with Dual Diagnosis and can encourage addicts to commit criminal acts of Narcotics daily. Severe Dual Diagnosis can be a narcotic user's lifetime. This research thesis is a normative research. The focus of this research is based on Primary Legal Material with Secondary Legal Material. The thesis analysis technique uses literature study, which is by studying basic and secondary materials. Based on an interview with a Judge in the Sleman District Court, namely Mrs. Ikha Tina, S.H., M.Hum., A word that could determine those people. Dual Diagnosis or not is a psychiatric expert, namely Doctor of Psychology. He also said, a Judge is very different from the judge's statement and also an expert. A decisive conclusion in breaking the Narcotics Criminal Case to issue a Dual Diagnosis to find people in this case the Psychiatric Expert, to determine those people Genesis or not. People who do Dual Diagnosis are included in the category of not being responsible.
