Abstract

MP3 is one of the most favourite file to listen a song in Indonesia. Almost everyone use file MP3 to play a song with MP3 player like winamp. In Indonesia there’s no legal MP3 distribution and it makes a lot of illegal MP3 distributed to people. Many merchant who sell pirated MP3 on the roadside and the problem is that music is copyrighted. This means that the maker of a work must grant permission before his work may be distributed on CD MP3. In the vast majority of the cases the copyright holder has not granted such permission, because most artists make money by selling CDs with their music. The music industry not surprisingly is complaining loudly about all the lost sales they claim to suffer because copyright holder didn’t get any royalty. The writing of this legal writing used empirical research and in this legal writing, the author conducted a research to know how the copyright protection of musical works in the form of MP3. Based on the result of author’s findings, it founded that musical work on MP3 type protected and regulated by Act Number 19 of 2002. It protected either in form and substance. The highest level of violation copyright music works that much happen on the distribution and sell of illegal MP3. Thus, it has been appropriate that copyright holder of music works produce and sell of legal MP3. Hopefully, legal MP3 will be more effective in depressing the level of illegal MP3 violation in Indonesia.
