Abstract

“Umbul Songo” water spring is an essential water source for Kopeng Village community to fulfill their water needs. The increasing number of the spring users certainly has an impact on the decreasing amount of water on the water reserves. Therefore, legal protection for “Umbul Songo” water spring is substantial in order to fulfill the community’s water needs in the future. The aims of this research are to describe the legal protection effort to “Umbul Songo” water spring connected to its conservation and to describe the problems of legal protection and how to resolve them. This research uses an empirical legal study approach. By focusing on the social facts, the researcher uses primary data, as predominant data, supported by secondary data. Data obtained from respondents and interviewees were analyzed qualitatively. Regulation of the Ministry of Environment and Forestry Number P.18 of 2019 has not optimally implemented because it has a general tendency and is not suitable for the social and economic of “Umbul Songo” water spring users. The finding of this research is the legal protection for “Umbul Songo” water spring has not optimally enacted because there are still overlapping authorities and its regulation application that has not fully functioned yet.
