Abstract

The thesis discusses about the legal protection of PT. Adira Finance against debtor’s collateral that the sales result does not pay the debt off due to impairment. The purpose is to comprehend the legal protection of PT. Adira Finance against debtor’s collateral that the sales result does not pay the debt off due to impairment. The research method uses the empirical-law method based on primary data which obtained from an interview. The secondary data was obtained from primary and secondary law-material. Meanwhile, the analytical method that is used is qualitative method through inductive process of thinking. The legal protection of the company is the executorial right, since the agreement that has been registered to Fiduciary Registration Office produces the certificate with statement “FOR THE SAKE OF JUSTICE BASED ON THE ONE DEITY” and temporary transfer of BPKB. PT. Adira Finance have considered the number of debtors which cause the stagnancy in the debt payment, yet it is not considered as the disadvantage. The company have fulfilled the operational standard procedure and any related procedures. It assumes that the debt that is not paid yet from the underhand sales result with the used dealer is the risk of the finance company .
