Abstract

The purpose of writing this thesis is to find out whether the decision of the arbitral tribunal is in accordance with the provisions of UNCLOS and to know the legal binding of the arbitration award regarding the South China Sea dispute between The Republic of Phillipines and The Republic of China. The method of this research uses normative research method. The data from this research were obtained by conducting a study of the Permanent Court of Arbitration award, literature, journals, news, and newspaper in accordance with the research material. The analysis was carried out by means of a grammatical and systematic interpretation. The results of this study are basically the mapping and claims on China’s nine dash line are actions that are not justified because in the UNCLOS provisions it doesn’t regulate those claims, and then the Permanent Court of Arbitration award have binding legal force, but actually there is no regulation related in the UNCLOS regarding the execution of the award that has been determined, so in implementing the awards it returns to the good faith of the parties that involved in the case.
