Abstract

This thesis examines the Policy of Indonesia About the scuttling of Ships Doing Illegal Fishing in the Territorial Sea of Indonesia in terms of the United Nations Convention on the Law of the Sea. the purpose of this research is to find out whether the Indonesian policy of sinking ships or not conflicting with the UNCLOS 1982 and whether such policies effectively as a means or way of law enforcement in the waters of. Indonesia's territory the sea of Indonesia. This research method using normative approaches with national and international law. After that with logical thinking and systematic a conclusion will be drawn using the methods of deductive thinking. To get the facts and accurate data, the researchers compared the condition existing in UNCLOS 1982 with existing provisions in national legislation which regulates the sinking ships and direct interviews in the Ministry of marine and fisheries in order to get adequate results. As the conclusions of this research was that the policy of Indonesia About the scuttling of Ships Conducting Illegal Fishing in the Territorial Sea of Indonesia in terms of the United Nations Convention on the Law of the Sea 1982 does not violate the conditions set in the UNCLOS 1982 and this policy is effective as a means of enforcement of marine territory waters in Indonesia.
