Abstract

Tobacco is one of the major commodities in Indonesia's economic sector, the tobacco market ,naves 111any parties includingtfarmers, laborers, traders and large industries. Tobacco is the largest contributor to excise duty for Indonesia. The system of buying and selling tobacco is an interesting thing to study, in the practice that occurs in the field, precisely between CV Hartono Jaya and tobacco farmers in Jombang Regency, the prevailing system is buying and selling by pre-artier or booking. The purpose of this study was to determine the practice of buying and selling tobacco between CV Hartono Jaya and tobacco farmers in Jombang Regency, and to find out how the impact of regulations regarding tobacco trading system on the formation of tobacco market prices. This legal research is an empirical legal research. Data collection was carried out by field studies and literature studies, while to analyze the results the authors used qualitative analysis methods that compared the data from field studies with secondary and primary legal materials. Based on the results of the author's research, the agreement with the pre-order system which in practice has been carried out for years is invalid and needs to be changed to the buying and selling system. Regulations related to the tobacco trade system have an influence 011 the formation of the selling price of tobacco in Indonesia. Jombang Rege11C)1 needs to formulate special regulations related to the tobacco trade system in its area so that the trade system does not side with one party only and is able to create the purpose of a trade system that is based 011 justice and efficiency.
