Abstract

The title of this research is a Review of The Judge’s Decision Number 1397/Pid.Sus/2020/ PN Sby About Procurement of Medical Equipments That Do Not Have License. There are private legal entities who made hand sanitizer independently, as done by the owner of CV Medistra Sarana Sukses which is proven that they sold hand sanitizer before the license from BPOM for the hand sanitizer is issued. The purpose of this study is to know and analyze the consideration of the judge's verdict and the conformity between the Law on Health and the judge's ruling contained in the Criminal Verdict Number 1397/Pid.Sus/2020/ PN Sby About Procurement of Medical Equipments That Do Not Have License. This research uses a normative writing method that focuses on positive legal norms in the form of laws and regulations regarding health and consumer protection, and also judge rulings contained in the Criminal Verdict Number 1397/Pid.Sus/2020/ PN Sby About Procurement of Medical Equipments That Do Not Have License. The conclusion of this research is that the judge in deciding each case does not always stick to the prosecutor's claim because the judge has the right to freely choose which charges are proven, because with high threats even the judge can give a light verdict even pure freedom and the judge in this case has reflected the principles of certainty, expediency and justice.
