Abstract

Since 2011 there has been an increase in the number of refugees in Europe. Most of these refugees are Syrian refugees. This wave of Syrian refugees could occur because of the civil war in Syria. This prompted the formation of an EU-Turkey treaty to address the refugee crisis that occurred in the European Union. the purpose of this research is to analyze and to find out whether the EU-Turkey Joint treaty for refugees crisis has violated the application of the principle of non-refoulement as the key principle in international refugee law and form of state responsibility of EU state and Turkey for violations of the principle of non-refoulement committed to Syrian refugees. This thesis uses normative research methods by reviewing literatures studies from convention, protocol, books, journals, and some sources from the internet which are related to nonrefoulement principal. The result of this research show, EU-Turkey Joint action is a form of European Union state and Turkey violation of the non-refoulement principle regulated in Article 33 paragraph (1) of the 1951 Convention giving rise to state responsibility, and state responsibility appears difficult to implement, especially for EU countries, this is because the EU is not one voice in dealing with refugee problems
