Abstract

Legal protection is needed for Indonesia women who married foreign citizens men and children born of such marriages different nationalities. According Act No. 62 of 1958 about the citizenship status of the wives of Republic of Indonesia appears to be aligned with the position of her husband. And the child does not have the right to determine their own citizenship. This resulted in the existence of discriminatory treatment for wives. so that it can be said of Act 62 of 1958 no less legal protection for women and children Indonesia birth. Act. No. 12 year 2006 about the citizenship status of the wives of Republic of Indonesia in substance far more advanced and democratic than the old one of law citizenship. This is because Act. No. 12 in 2006 to accommodate its creation has thoughts that lead to granting legal protection to women and children of mixed marriages. Act No. 12 year 2006 were considered to be discriminatory because it is based on the principle of equality, so in accordance with human rights and the Constitution 1945. In practices, the government should guarantee that it’s easy for every citizen, especially women and children whom born of mixed marriages in exercising their rights and obligations as citizens of Indonesia in accordance with the applicable rules.
