Abstract

The modern era has transformed the play habits of children, shifting from face-to-face interactions to virtual-based games, particularly Online Games. Children engaged in online gaming often partake in virtual token transactions. However, these transactions may lead to instances of non-performance (wanprestasi) by reseller token sellers. According to Article 1330 of the Indonesian Civil Code (KUH Perdata), children are considered legally incapacitated individuals, prompting the question of legal protection in cases of wanprestasi by resellers.This research adopts a normative legal research methodology to explore the legal framework surrounding transactions involving the sale and purchase of virtual tokens through social media platforms. The findings highlight two primary approaches to legal protection for children: preventive and punitive measures. Preventive legal protection involves the establishment of regulations mandating social media service providers (social commerce) to employ third-party entities as transaction guarantors for transactions involving children, such as joint accounts. On the other hand, punitive legal protection involves filing wanprestasi claims against resellers in court, represented by the parents or legal guardians of the children.
