Abstract

The influx of Rohingya refugees to Indonesia and other countries since 1978 has been a humanitarian disaster. They are stateless people because the Myanmar Government does not grant them citizenship status. The problem in this study is whether Myanmar has granted the right to citizenship to ethnic Rohingya in accordance with international law related to the right to citizenship status. The purpose of this study is to determine whether Myanmar has granted the right to citizenship to ethnic Rohingya in accordance with international law related to the right to citizenship status. This article examines the status of the Rohingya community through the lens of international law, specifically focusing on the right to citizenship that are enshrined in various international legal insrument by delving into relevant legal frameworks such as the ICCPR and the 1954 Convention. In addition, it explores the implications of Myanmar's domestic laws and policies on citizenship, including the 1982 Citizenship Law, which render the Rohingya stateless. The author argues that Rohingya people are entitled to the right to citizenship based on the virtue of humanity and historical backgrounds. The author suggests that, the Myanmar government should amend or revise the 1982 Myanmar Citizenship Law. Myanmar government should ratify the 1966 ICCPR, 1951 Covenant, and 1954 Convention. These steps must be taken so Myanmar can improve her respect towards human rights and protect her citizen.
