Abstract
North Korean refugees face repressive actions from their home country, prompting them to experience fear and seek refuge in other nations. South Korea is a country willing to accept and protect North Korean refugees. This research explores the implementation of South Korea's efforts in protecting North Korean refugees and addressing the discrimination issues they face within South Korea. The study aims to evaluate South Korea's efforts in protecting North Korean refugees based on the principle of non-discrimination. The research methodology employs a normative legal research approach, utilizing primary and secondary legal sources, along with interviews with relevant stakeholders. The findings reveal challenges faced by the South Korean government in protecting North Korean refugees based on the nondiscrimination principle. This is attributed to the South Korean government's policies that have not sufficiently made refugees feel secure, such as the North Korean Refugees Protection and Settlement Support Act, which has resulted in the ineffective implementation of the Hanawon Resettlement Program. The recommendation from this research is that the South Korean government provides an educational program to enhance public awareness and understanding of North Korean refugees. Additionally, North Korean refugees should receive psychological support and training to assist in their integration into South Korean society.
