Abstract

The problem in this legal research was the failure of debtor in the implementation of debt contract and what barriers faced by Micro Financial Institution Karya Mandiri in completing the fail of debtor in the implementation of debt contract. Meanwhile the purpose of this legal research was to know and analyze what efforts had been conducted by Micro Financial Institution Karya Mandiri toward the failed debtor emerging in the implementation of debt contract and its barriers. This research has been conducted by the author, was empirical legal research, i.e. a research that gain primary data as main data, which was taken from Micro Financial Institution Karya Mandiri in Kuningan Regency through interview to the Leader, Treasury and some respondents. Based on the result gained from this research, this the completion toward the failure of debtors in Micro Financial Institution Karya Mandiri is given bills, and then they are required to go to the office. It is also conducted by negotiation and charged 1% of fee. Meanwhile the barriers in its completion comprises of 3 factors, i.e. economical factor from the part of debtor itself, sociological factor, either from the part of Micro Financial Institution or even form the part of debtor. The third factor is juridical, namely concerning on any given regulation that was not established in writing, however only verbally, thus it has weak legal authority.
