Abstract

The violation of human rights and discrimination to female workers are still happened in a great number. The fulfillment of human rights for enjoying their rights as women, likes in the case of reproduction health, e.g. menstruation, pregnancy leaf, or breasting the baby is often obeyed by the employers. Atma Jaya Yogyakarta University as one of the universities having female workers inside also has responsibility to fulfill the female workers' right. The purpose of this legal research was to know and finding out data on the implementation of giving menstruation leaf rights, knowing and finding the factors impeding the implementation of giving menstruation leaf rights to the workers in Atma Jaya Yogyakarta University, and to know and analyze the gender perspective to the female workers' right to menstruation leaf. The kind of this research was empirical legal research by using questionnaires to the respondents, i.e. female workers in Atma Jaya Yogyakarta University. The result of this research is Atma Jaya Yogyakarta University has not give pregnant leaf right and there isn't any rulers inside concerning on the mutual working agreement. The factors impeding implementation of menstruation leaf from is the part of foundation perceives that menstruation leaf is not necessary because if the workers have sickness during their menstruation period, they can ask permit for not going to work by the reason of sick. From the part of workers that consider that menstruation leaf is not an important thing, by the reason it is female faith. In addition, there is any medicine that can relieve this sickness. The suggestion from the author is in order the regulations on menstruation leaf in mutual working agreement between the Slamet Riyadi Foundation and workers, should establish the revision on regulations concerning on the working relation, that up to now it still only refers to the worker regulations. Gender perspective on menstruation leaf rights still contains uncertainty.
