Abstract

Copyright is an exclusive right that arises automatically based on the declarative principle after a creation is realized in tangible form without prejudice to restrictions in accordance with the provisions of laws and regulations. Basically, every work produced by someone is an object protected by intellectual property rights, including on the TikTok application. TikTok application users are allowed to upload content (works) without any restrictions on text, photos, user videos, sound recordings and music works contained in sound recordings. This means that any content created on the TikTok app must not violate copyright. So, it is necessary to know whether the video created by the TikTok application is a copyright infringement and whether the work of the TikTok application in the form of a video is a work protected by copyright. This legal research uses normative legal research methods that focus on regulations and legal norms. The result of this legal research is that videos on the TikTok application that use other people's works without permission are infringement and videos from the TikTok application are protected copyrighted works if the work does not infringe copyright and has obtained permission from the creator.
