Abstract
The rise of online transactions has revolutionized commerce, bringing unprecedented convenience and efficiency. Yet, alongside this shift, jurisdictions like Indonesia face a host of legal hurdles as laws struggle to adapt to the complexities of online commerce. This thesis delves into the legal underpinnings of online transactions in Indonesia, scrutinizing legislative mandates, court rulings, and regulatory frameworks shaping e-commerce. Through a meticulous examination, the study explores the rights and responsibilities of stakeholders, spanning consumers, businesses, and intermediaries. It also evaluates the effectiveness of existing laws in tackling prevalent issues like fraud, data privacy breaches, and contractual disputes in the digital sphere. By critically analyzing the current legal landscape, this research aims to pinpoint gaps, ambiguities, and avenues for enhancement in Indonesian e-commerce laws. Ultimately, it provides insights and recommendations to policymakers, legal professionals, and stakeholders to bolster legal certainty, consumer protection, and the efficacy of e-commerce regulations in Indonesia.
